California Employment Laws

In California, worker's rights and employment standards are enforced by the LETF or Labor Enforcement Task Force. The LETF coalition several state government entities that oversee working conditions, employee rights, and other regulatory measures to ensure that workers are treated fairly.

LETF includes the following agencies:

  • State Attorney General
  • Division of Labor Standards Enforcement
  • Employment Development Department
  • California Department of Tax and Fee Administration
  • And more

These agencies work together to ensure safety and protect workers. The LETF also works to guarantee the rights of workers in California businesses, including the right to:

  • Rest and meal breaks
  • Safe and healthy jobs
  • Action without retribution
  • Disability and unemployment benefits
  • Minimum wage and overtime

It is also important to note that workers' rights extend to their contracts with employers. For example, if you are promised certain benefits and a specific salary, the employer must uphold those terms or face litigation. You have the right to pursue legal action if your employer violates a term of the contract or discriminates against you.

Discrimination Defined

Discrimination is the denial of rights and equal opportunities based on the employee's membership in a protected group. Protected groups are categories of attributes that may apply to anyone like race, religion, class, gender, and sexuality. Racial and gender bias are some of the most common groups discriminated against in the workplace, but if anyone in a protected group is mistreated, the employer could face federal and state penalties.

The Fair Employment and Housing Act protects employees from discrimination through the following:

  • Ads
  • Resume applications, screening, and interviews
  • Hiring, promoting or terminating employees
  • Compensation and working conditions
  • Participation in apprenticeship programs or educational programs
  • Union participation

Most people understand discrimination to be based on one's membership in a protected class which is a significant part of the equation, but another critical factor is the context in which it occurs.

For example, an employer could be guilty of gender discrimination if they terminate a female employee after finding out she is pregnant.

Another example would be if an employer gives more vacation and a higher salary to white employees than people of color.

There are endless combinations of discriminatory practices and marginalized or protected groups. Unfortunately, despite increased awareness and acknowledgment of discrimination, it still occurs on a large scale in the United States.

The best thing you can do if you are experiencing discrimination is to contact an attorney as soon as possible. You may be able to pursue compensation and get the justice you deserve.
